These Terms of Service (“Terms”) govern your use of the Colorado Coil Cleaning website and, where applicable, your engagement of our coil-cleaning services. By accessing the site or requesting or accepting services, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the website or request services.
1. About Colorado Coil Cleaning
Colorado Coil Cleaning provides specialized commercial HVAC coil cleaning (including condenser coils, evaporator coils, rooftop units, air handlers, and related multi-unit cleaning) for property operators and as a subcontracting resource for HVAC and mechanical contractors in Colorado Springs and the Front Range.
Important scope limitation: We specialize in coil cleaning. Unless separately agreed in writing, we do not provide HVAC diagnostics, refrigerant work, compressor or electrical repair, furnace or AC repair, installation, replacement, duct installation, or mechanical system modification.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to request commercial services. If you represent a company, you confirm you are authorized to bind that company to these Terms and any project-specific agreement.
3. Website Use
You agree to use the website only for lawful purposes. You agree not to:
- Violate any applicable law or regulation
- Attempt unauthorized access to the site, servers, or related systems
- Interfere with site operation, security, or other users
- Scrape, harvest, or misuse contact forms for spam or competitive intelligence in bad faith
- Upload malware or harmful code
- Misrepresent your identity or affiliation
We may suspend or restrict access for misuse or security reasons.
4. Quotes, Estimates & Pricing
Website content and quote requests are invitations to discuss work—not binding offers until we confirm scope and price. Estimates are based on information you provide (equipment, unit count, condition, access, travel, photos, and related details). Final pricing may change if site conditions differ from what was described.
We do not publish fixed menu pricing because projects are scoped individually. Free estimates do not obligate either party to proceed.
5. Service Engagements
Project-specific terms—including scope, price, schedule, access requirements, payment, cancellation, and documentation—are governed by our written quote, work order, invoice, or subcontract agreement. If those documents conflict with these website Terms, the project documents control for that job.
You agree to provide safe, lawful access to equipment and accurate information needed to perform the work. Delays, denied access, unsafe conditions, or undisclosed restrictions may result in rescheduling or additional charges.
6. Contractor Relationships
When we work as a subcontractor, we coordinate under the direction of the hiring contractor or account holder as agreed. We do not compete for mechanical repair or install work that remains with your technicians. Customer relationships introduced through a contractor partnership remain subject to the contractor’s agreements with their customers unless otherwise agreed in writing.
7. No Performance Guarantees Beyond Scope
Coil cleaning can help remove dirt, dust, cottonwood, pollen, grease, and other buildup that may interfere with airflow and heat transfer. Results vary by equipment condition, prior maintenance, and site factors. Website statements about performance, efficiency, or maintenance benefits are general information—not warranties of specific energy savings, equipment life extension, or repair outcomes.
Unless expressly stated in a signed project agreement, all services are provided “as is” to the fullest extent permitted by law, and we disclaim implied warranties of merchantability and fitness for a particular purpose.
8. Intellectual Property
Website content, branding, logos, and design are owned by Colorado Coil Cleaning or its licensors and are protected by intellectual-property laws. You may not copy, modify, or commercially exploit site materials without prior written permission, except for reasonable personal or internal business use of publicly available pages.
9. Illustrative Imagery
Some photographs and visuals on the site are illustrative and may not depict Colorado Coil Cleaning employees, clients, or completed projects. Do not rely on illustrative media as proof of a specific past job.
10. Third-Party Services
The site may link to or integrate third-party services (maps, form processors, hosting, payment tools). Those services are governed by their own terms and privacy policies. We are not responsible for third-party content or practices.
11. Limitation of Liability
To the maximum extent permitted by Colorado law:
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, even if advised of the possibility
- Our total liability arising out of website use or a particular service engagement will not exceed the fees you paid us for that engagement (or $100 for website-only claims where no fees were paid)
Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the fullest extent allowed.
12. Indemnification
You agree to indemnify and hold harmless Colorado Coil Cleaning and its owners, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the website, inaccurate information you provide, unsafe site conditions you control, or your breach of these Terms—except to the extent caused by our gross negligence or willful misconduct.
13. Privacy
Personal information submitted through the site or during service engagement is handled as described in our Privacy Policy.
14. Changes
We may update these Terms by posting a revised version with a new “Last updated” date. Continued use of the website after changes constitutes acceptance. Material changes to an active project will be addressed in that project’s written agreement.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Exclusive venue for disputes arising from these Terms or website use shall be the state or federal courts located in El Paso County, Colorado, unless a project agreement specifies otherwise. You consent to personal jurisdiction there.
16. Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
